Nick Jenkins

Nick Jenkins has been a civil litigator since 2001. Nick’s practice has focused on the defense of lawyers and real estate agents in professional liability claims, the defense of insurers in claims of bad faith claims handling practices, and the representation of insurers in coverage litigation arising from claims of complex property damage and errors and omissions occurring over decades-long timeframes. He has also successfully defended multiple construction contract claims, including defense of Mason County against claims by a general contractor arising from the Skookum Creek Bridge project in southern Washington.

He has secured multiple summary judgment dismissals for his various clients. Invoking the First Amendment prohibition on civil entanglements with religion, he secured dismissal of claims against a synagogue and its directors (Buttnick v. Congregation Bikur Cholim Machzikay Hadath). He won dismissal of legal malpractice claims against an estate planning attorney relative to a joint trust plan prepared by the lawyer (Hart v. Brown); professional liability claims against a real estate agent based on the buyer’s default under an unsecured promissory note (Klick v. Diviney); negligence claims against a fire escape maintenance and repair company arising from the collapse of a building’s external fire escape (Krilich v. The Safety Team, Inc. et al); claims against a decedent’s Estate for childhood sexual abuse (Miller v. Campbell); and claims against a building security company for personal injury claims brought against the building’s tenant (Wilkins v. N.W. Legal, at al).

In addition to his trial court practice, Nick has successfully briefed and prosecuted multiple appeals. Representing a construction subcontractor, Mr. Jenkins secured reversal of a trial court ruling granting a general contractor’s extra-contractual claim for $85,000.00 in attorneys’ fees (Blueberry Place Homeowners’ Association v. Northward Homes, et al).

Nick received his J.D. degree in 2001, Cum Laude, from Seattle University School of Law, where he received the CALI award for first in his Contracts class. He completed his undergraduate work at the University of Washington, graduating Magna Cum Laude from with a B.A. degree in Political Science and Communications. He also earned the Phi Beta Kappa distinction. He was voted a “Rising Star” in 2006 by the readers of Washington Law & Politics.

In addition to his state court practice, Nick is admitted to the federal courts of both the Western and Eastern District of Washington. He is a member of the Washington State Bar and Washington Defense Trial Lawyers Association.
